The terms “we”, “us” and “our” refer to The Stainless Co., a brand operated by Resoluta B.V., a company registered in the Netherlands. Resoluta B.V. operates this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”), in order to provide you, the customer, with access to our products and a secure online shopping experience.

Our store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.

These Terms and Conditions, together with any policies referenced herein, including our Privacy Policy and Return and Refund Policy, describe your rights and responsibilities when you access or use our Services.

Please read these Terms and Conditions carefully, as they contain important information about your legal rights, limitations of liability, disclaimers, and dispute resolution.

By visiting, accessing, browsing or using our Services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

Section 2 - Access to the Services and Account Responsibility

By agreeing to these Terms and Conditions, you represent that you are at least 18 years of age or have reached the age of majority in your country of residence. If you are under 18 years of age, you may only use our Services under the supervision of a parent or legal guardian.

To use certain features of our Services, including placing orders, you may be required to provide personal information such as your name, email address, billing address, shipping address, and payment details.

You represent and warrant that all information you provide is accurate, complete and current. You agree to promptly update your information if it changes.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You may not transfer, sell, assign or otherwise allow third parties to use your account.

We reserve the right to suspend or terminate your access to the Services if we suspect fraudulent activity, misuse, or violation of these Terms.

Section 3 - Products and Product Information

We make every reasonable effort to ensure that product descriptions, images and specifications on our website are accurate and up to date.

However:

• Colours and appearance may vary depending on your device and display settings.
• Minor variations in product finish, material texture or packaging may occur.
• Product descriptions are subject to change without notice.

We do not guarantee that the appearance of any product will exactly match images displayed on your screen.

We reserve the right to:

• Modify or discontinue products at any time.
• Limit quantities available for purchase.
• Restrict sales to specific regions or customers.

Section 4 - Orders and Contract Formation

When you place an order, you are submitting an offer to purchase products.

A legally binding agreement is formed only when you receive an order confirmation email from us confirming acceptance of your order.

We reserve the right to refuse or cancel any order, including but not limited to cases involving:

• Pricing errors
• Technical errors
• Suspected fraud
• Payment authorization issues
• Product unavailability

If we cancel your order after payment has been received, we will refund the full amount paid.

Once an order has been confirmed, we may not be able to stop it before it is dispatched. This does not affect your right of withdrawal under Section 7, which applies from the moment you receive your order.

All purchases are subject to our Return and Refund Policy.

You represent that products purchased are intended for personal use and not for resale, export, or commercial distribution unless explicitly agreed in writing.

Section 5 - Prices and Billing

All prices displayed on our website are shown in euros and include VAT, unless otherwise stated.

Shipping costs, if applicable, are displayed separately during checkout.

Prices and promotions are subject to change without notice. The price applicable to your order is the price displayed at the time of checkout and confirmed in your order confirmation email.

You agree to provide valid and authorized payment information. You confirm that:

• You are authorized to use the selected payment method.
• The payment information provided is accurate and complete.
• You will pay all charges incurred, including taxes and shipping fees.

If your payment is declined or reversed, we reserve the right to suspend delivery or cancel your order.

Section 6 - Shipping and Delivery

Delivery times displayed on our website are estimates and not guaranteed.

We are not liable for delays caused by:

• Shipping carriers
• Customs processing
• Incorrect address information
• Force majeure events

Risk of loss or damage passes to you upon delivery of the goods to the address provided during checkout.

If a package is returned to us due to incorrect address details provided by you, additional shipping costs may apply.

Section 7 - Right of Withdrawal

If you are a consumer, you have the right to cancel your order up to 30 days after receiving it, without giving a reason. That is longer than the 14 days European law requires — we give you 30.

After cancelling, you have another 14 days to send the product back.

You then get the full order amount credited, including the shipping costs of the original delivery. Only the cost of returning the product from you to us is yours. We will transfer the amount owed within 14 days of your cancellation, provided the product has been received back in good order.

If you exercise your right of withdrawal, you must:

• handle the goods received and their packaging with care. You may only unpack or use the goods as far as is needed to establish their nature, characteristics and functioning. If you handle them in any other way, you are liable for any resulting loss of value, unless we failed to provide you with all legally required information about the right of withdrawal before or when the contract was concluded;
• return the goods to us within 14 days, counted from the day after the day on which you notified us that you wish to withdraw from the contract. The direct costs of returning the goods are yours, because we informed you of this before the contract was concluded;
• return the goods as far as possible with all accessories supplied, in their original condition and packaging, and in accordance with the reasonable and clear instructions we have given you.

The statutory exceptions to the right of withdrawal do not apply to our range. Every product we sell can be returned, gift cards included.

Nothing in these Terms limits your statutory rights under European consumer protection law.

• Logos

• Product descriptions
• Design elements
• Layout and structure

is the property of The Stainless Co. or its licensors and is protected by intellectual property laws.

You may use our website for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, publish, transmit or exploit any content without prior written consent.

Unauthorized use may result in legal action.

Section 9 - Optional Tools and Third Party Services

Our Services may include access to tools or services provided by third parties.

We provide such tools on an “as is” and “as available” basis without warranties or endorsements.

We are not responsible for third party content, policies or practices.

Your use of third party services is at your own risk.

Your submission of personal information through our website is governed by our Privacy Policy.

Because our website is hosted by Shopify, certain personal data may also be processed by Shopify in order to operate and maintain the platform.

By using our Services, you acknowledge that your data may be transferred and processed in accordance with our Privacy Policy.

Section 11 - Feedback and User Content

If you submit reviews, feedback, suggestions or other content, you grant us a non-exclusive, royalty-free, perpetual right to use, reproduce, publish and display such content for marketing and business purposes.

You represent that your content:

• Is not unlawful or defamatory
• Does not contain harmful code

We reserve the right to remove content at our discretion.

Our customer reviews are managed impartially by WebwinkelKeur. We do not edit, filter or remove reviews on the basis of how favourable they are.

Section 12 - Errors and Omissions

Occasionally, our website may contain typographical errors or inaccuracies relating to product descriptions, pricing or availability.

We reserve the right to correct errors and cancel orders if necessary.

Section 13 - Prohibited Uses

You may not use our Services:

• To engage in fraudulent activity
• To interfere with website functionality

We reserve the right to terminate access for violations.

Section 14 - Disclaimer of Warranties

To the extent permitted by law, we disclaim warranties except where statutory consumer rights apply.

Nothing in these Terms excludes rights that cannot be limited under mandatory law.

In addition to your statutory rights, we provide a ten-year guarantee on the stainless steel in everything we sell. That guarantee is described on our guarantee page. It is offered alongside your statutory rights under Dutch and European consumer law, including the statutory conformity guarantee, and does not replace them.

Section 15 - Limitation of Liability

To the fullest extent permitted by applicable law, Resoluta B.V. shall not be liable for indirect or consequential damages arising from the use of our Services or products.

This limitation does not apply in cases of intent, gross negligence, or where liability cannot legally be excluded.

Section 16 - Indemnification

You agree to indemnify and hold harmless The Stainless Co. and Resoluta B.V. from claims resulting from your breach of these Terms or misuse of the Services.

Section 17 - Governing law, complaints and disputes

These Terms are governed by the laws of the Netherlands.

If you have a complaint about our products or service, please raise it with us first at hello@thestainless.co. We confirm receipt within 2 business days and give a substantive response within 14 days. The full procedure is on our complaints page.

If we cannot resolve it together, you can submit your dispute for mediation through WebwinkelKeur, at https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil. WebwinkelKeur will mediate between us.

Disputes that are not settled amicably will be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.

Section 18 - Changes to These Terms

We reserve the right to update or modify these Terms at any time.

The latest version will always be available on this page.

Continued use of the Services after changes constitutes acceptance of the updated Terms.
